Application. Requirements for describing the boundaries of hunting grounds

Application

1. The description of the boundaries of the hunting grounds begins from the northwestern point. Then, first, the northern, then the eastern, then the southern, and lastly, the western borders are described sequentially. The segments of the boundaries are selected based on the configuration of the territory on the ground, but their common vector must correspond to the specified side of the world.

2. The northern border is described from west to east, the eastern one - from north to south, the southern one - from east to west, the western one - from south to north.

3. The description of the end point of the segment of each border must match the description of the start point of the next border, and so on from left to right from the northwest point until returning to it.

4. Description of the boundaries of hunting grounds without the use of navigation devices is possible only by clearly visible on the ground and long-lasting landmarks: coastlines or fairways of internal permanent and external water bodies, existing railways, paved roads or roads with road ditches, mountain ranges and peaks operating high-voltage power lines.

5. The description of other segments of the boundaries of hunting grounds is duplicated by the image of an electronic track, combined with a cartographic base, obtained using navigation devices or special computer programs that have the ability to work with spatial data in a system of geographical coordinates.

6. When describing the boundaries of hunting grounds that cross or go to railways and highways (specified in paragraph 4 of these Requirements), the place where the border of the hunting grounds crosses this road and the cadastral name of the road is indicated. When describing the boundaries of hunting grounds passing along railways and roads, all settlements that are located on these roads and through which the border of the hunting ground passes are also indicated.

7. When describing the boundaries of hunting grounds running along watercourses, the names of the watercourses and the landmarks for the exit of the boundary of the hunting ground to the watercourse (mouth, source, for navigable rivers - a kilometer according to the sailing direction), the direction of the border relative to the flow of the watercourse, the coast (right or left), along which the boundary or dividing line of the watercourse passes (fairway, middle course). If there are islands on the watercourses, it is indicated on which coast of the island (right or left) the boundary of the hunting ground passes.

8. When describing the boundaries of hunting grounds according to the quarterly network of the forest fund, the location of the boundaries of the quarter relative to the cardinal points, the number of the quarter and its belonging to forestry and forestry are indicated.

9. If the name of a landmark has several variants of names in different sources (maps, plans), then when it is mentioned for the first time, any name is used, and all other names are indicated in brackets. In subsequent mentions, only the name that was used as the main one for the first time (before brackets) is used.

10. When describing the boundaries, it is not allowed to use the wording: "... and further along the border of the hunting ground ..." or "... from the hunting ground ...". Adjacent boundaries of hunting users should be registered according to common guidelines.

11. All landmarks used in the description of the boundaries of the hunting grounds must be indicated on the diagram (map), which is an integral part of the description.

Very instructive information came from the Tver region: in connection with the failure to comply with federal legislation on territorial hunting management, the lack of a scheme of hunting grounds and a map describing the boundaries, the failure to adopt an administrative regulation for conducting inspections during state supervision, the deputy governor of the Tver region V.V. Melnikov (familiar surname - note, V.B.), whose competence was to ensure the conservation and use of hunting resources, the protection of hunting grounds, the protection and reproduction of wildlife, resigned. Why instructive? So after all, territorial hunting management has not been carried out not only in the Tver region, there are no hunting grounds:

  • nor in Kostroma,
  • not in Vladimirskaya,
  • nor in Nizhny Novgorod,
  • not in Ryazan,
  • not in Tula,
  • not in Kaluga
  • not in Smolensk and many other regions ...

And this is not surprising: this is the state policy implemented by the Department of the Ministry of Natural Resources of Russia under the leadership of outfitter A.E. Bersenev. Although, it will be more correct and honest - ANTI-state. Why ANTI? Yes, because you have to pay money to the state for the use of hunting grounds. No hunting grounds - no corresponding payments to the budget! Long-term license holders, charging hunters for hunting, today practically receive a net profit, incurring expenses only for their own maintenance: salary, etc.


For several years, V. Bodunkov was talking about the lack of hunting grounds in Russia, and now all of a sudden - bam and the “heads” of ministers and their deputies “flew”, although if you really “chop heads”, so higher - to those who did not deploy state policy to protect the interests of the state , hunters and wildlife, but to protect the private interests of hunting users.

Drawing up a diagram and map with an accurate description of the boundaries of the hunting grounds - yes, this is exactly the information that I wanted to hear from the director of the Department of State Policy and Regulation in the Field of Hunting and Wildlife Objects A.E. Bersenev, but I never heard.

But the provision of services and other activities in the field of hunting for the purposes of amateur and sport hunting can be carried out by legal entities and individual entrepreneurs only in assigned hunting grounds. The long-term license granted legal entities the right to hunt and has nothing to do with the provision of services or other activities in the field of hunting. The scale of legalized lawlessness in granting the right to hunt kills any desire to be a law-abiding citizen.

This is what I wrote about in articles and forums, I asked experts and hunters - where can I find in any region the Scheme for the allocation, use and protection of hunting grounds, and with it a map with the exact designation of the boundaries of hunting grounds? In vain!!! How much malice, gloating, and just outright rudeness I had to listen to in my address for my indefatigable desire to live according to the laws, and not according to concepts ... It sounded especially painful from the lips of undeniably literate hunters, but living on the principle "my hut is on the edge" ...

And the head of the Mosoblohokhotupravleniya said to my face: “WE believe that the territories, water areas transferred for use under a long-term license are hunting grounds ... As long as I hold this position, I will not allow a repetition of the Ivanovo scenario of transferring territories to public hunting grounds.”

Why was I so persistent in my search for the approved Hunting Area Scheme? The answer is extremely simple: the Scheme of hunting grounds is a document of territorial hunting management aimed at ensuring the rational use and conservation of hunting resources, the creation of hunting infrastructure on the territory of a subject of the Federation. In the development of the territorial, on-farm hunting should be carried out in the assigned hunting grounds, and as compensation for the costs incurred, the right to provide services and other activities in the field of hunting should be granted. It is this strategy for the development of the hunting industry that is defined by the Federal Law "On Hunting ..."...

The topic of creating hunting grounds in the conditions of modern Russia seems to me the most important, therefore I consider it vital to tell about this in more detail. I propose to start with the basics - the Explanatory Dictionary of the Russian Language, where “a land is a place, a territory as an object of agricultural use or as a hunting place (forest, lake, field, swamp). Forest, land, water, swamp, agricultural, hunting grounds. So, a site is a territory or water area, respectively, legal relations should be regulated by the relevant legislation.




In 2001, a new Land Code of the Russian Federation was put into effect, in which the concept of “hunting grounds” is not used, but there are “agricultural lands - arable land, hayfields, pastures, fallow lands, lands occupied by perennial plantations, which, as part of agricultural land, have priority in use and are subject to special protection.

I especially draw your attention, dear fellow hunters, farmland lands have a PRIORITY IN USE and are subject to SPECIAL PROTECTION.

Article 23 of the Land Code of the Russian Federation establishes the norms of land law in terms of the limited use of someone else's land or easement. What does this mean? Yes, everything is tritely simple, the owner of a land plot may be compulsorily obliged or burdened to provide his plot for:

  • passage or passage;
  • carrying out drainage works;
  • water intake and watering place;
  • free access to the coastal strip;
  • driving or grazing livestock;
  • hay and ATTENTION: use of the land plot FOR THE PURPOSES OF HUNTING, FISHING in a closed reservoir located on the site and COLLECTION OF WILD GROWTHS in the prescribed time and in the prescribed manner.

But “hunting management” or “carrying out activities in the field of hunting management” on someone else's land is not provided for by the easement ...

On January 1, 2007, a new Water Code of the Russian Federation was put into effect, in the basic terms of which “hunting grounds” are also not used. And only in the Forest Code of the Russian Federation, forest plots provided on the basis of lease agreements for hunting management - business activities related to the provision of services to persons engaged in hunting, were recognized as hunting grounds.

I don’t know why, but the former hunting farms practically did not use this legal norm, even though the rent for the use of a forest plot for hunting was ATTENTION: 3 kopecks per hectare per year!!!

In pursuance of the provisions of the Federal Law "On the Fauna" after 14 years (!!!) in July 2009, three readings were held in the Duma within two weeks and was signed by the President of the Federal Law "On Hunting ...", and on July 28 the law was officially published for public information . Instead of the concept of "habitat of the animal world - the natural environment in which objects of the animal world live in a state of natural freedom" provided for by the law on wildlife, the law on hunting adopted the concept of "hunting grounds - territories within the boundaries of which it is allowed to carry out activities in the field of hunting”; instead of “objects of the animal world (wild animals)”, a new concept of “hunting resources” has been introduced ...

In Soviet times, “hunting grounds were recognized as all land, forest and water-covered areas that serve as a habitat for wild animals and birds and can be used for hunting” (which today corresponds to the concept of “habitat of the animal world”) and this was quite understandable: territories and hunting animals were public property and had only one owner or owner - the people.

Today, in the conditions of private ownership of land and other natural resources, only those lands are included in the boundaries of hunting grounds, the legal regime of which allows the implementation of activities in the field of hunting. What are these lands? First of all, these are land and forest plots, ATTENTION - IN STATE OWNERSHIP... Private lands cannot be included in the hunting grounds!

Dear fellow hunters, look around you - do you see a lot of free land that has not been transferred to anyone and is in state ownership? For more than ten years, our fellow citizens and legal entities have received land plots for use and bought land plots in accordance with the current legislation without encumbrance, and now suddenly the new law on hunting somehow suggests that these lands be considered "hunting grounds" ...

The vast majority of our fellow citizens own apartments. Now imagine that some newly adopted law declares these apartments communal with all the ensuing consequences ... You say: this cannot be! Maybe.

A clear example of this is the Federal Law "On Hunting ...", which amended the previously adopted Federal Law "On the Animal World", the Federal Law "On Weapons", the Federal Law "On the Development of Agriculture", the Land, Forest, Water, Criminal Codes of the Russian Federation and the Code of Administrative Offenses of the Russian Federation. Now the property rights of individuals and legal entities to land plots and other rights to land within the boundaries of hunting grounds are limited by the Federal Law "On Hunting ...".

Already today, conflicts arise, especially in the southern regions, between landowners and hunters, whom the land owners simply drive out of their territories and do not allow to hunt, explaining their actions by causing damage. I can imagine what kind of confrontation will begin when agricultural land will simultaneously turn into hunting grounds ...

Here is what Ivan Petrovich Larionov from Ryazan says: “ Private ownership of agricultural land is a tragic mistake for all of Russia. I came to this immediately in the late nineties, having barely worked on the land survey for 3 years. Immediately, the lands began to be redistributed not for farming and the peasantry, but began to be concentrated in the hands of those same newly-minted "princes", giving rise to new latifundists. That same Kushchevka is the first derivative of this process. But the saddest thing is that it will not "roll back" bloodlessly - it will not work. As a rule, a large redistribution of land is associated with "big blood". And owning plots of land comparable to entire regions of the region, it is stupid not to have the right to "create" your own hunting on this land. What is happening. And if he (the owner of these lands) does not need this hemorrhoids, he will eventually understand that it is possible to demand compensation from the hunting user for the use of lands (grass, burns, hiding pits, eco-damage, etc.) and will prove that payments for this they will again fall on ordinary hunters. Agricultural land should be state-owned, there would be fewer problems, but they don’t even want to hear about it then, nor now, gentlemen, managers!».

And in my opinion, neither land, nor subsoil, nor natural resources should in any way be in private ownership!

So can "hunting grounds" appear under conditions of private ownership of land? In my understanding, this is more a myth than a reality, for one simple reason: the same land plot cannot have two owners - a land user and a hunter.

The term "habitat of the animal world" should be correctly applied - the natural environment in which objects of the animal world live in a state of natural freedom. Only in this case, game animals living on private lands are subject to appropriate protection.

And the sooner we abandon the outdated practice of fixing hunting grounds, the sooner the intermediary between the state-owner of the animal world and the hunter, the so-called “hunt user”, will disappear, performing the functions of a pad for absorbing financial flows, both from the state and from hunters. At the same time, money is practically not invested in the reproduction of game animals, settling in private pockets ...
